Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Confetti Drop, including the iOS app, the website at confettidrop.app, and related features (the “Service”). By creating an account, accepting these Terms in the app, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

These Terms describe how Confetti Drop works today. They are not a substitute for advice from your own lawyer. Questions: hello@confettidrop.app.

1. The Service

Confetti Drop helps people collect messages, photos, and related celebration content for a Drop that unlocks at a chosen reveal. Organizers create Drops, invite contributors, manage wishlists or plans where available, and open the reveal experience for recipients. Features may change as we improve the product.

Current App Store scope. The live version focuses on messages, photos, memories, and wishlist/plans. Video, voice notes, and cash gift collection are not offered until they are production-ready. Mentions of future features in marketing or docs do not promise availability.

2. Eligibility

You must be at least 13 years old to create an account and use Confetti Drop. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts and sign-in

You must provide accurate information and keep your email inbox secure. We use email one-time codes to sign you in. You are responsible for activity under your account. Notify us promptly at hello@confettidrop.app if you believe your account was accessed without permission. We may suspend or terminate accounts that are inaccurate, unsafe, or abusive.

When you create or sign in to an account, you must accept these Terms and our Privacy Policy. We may record the time of acceptance.

4. Your content

You retain ownership of content you submit (messages, photos, profile details, Drop settings, and similar materials) (“Your Content”). You grant Confetti Drop a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely as needed to operate and improve the Service (for example showing a contribution inside a Drop, generating thumbnails, moderating reports, and backing up data).

You represent that you have all rights needed to submit Your Content and that it does not violate law or these Terms. You are responsible for Your Content.

5. Zero tolerance for objectionable content and abuse

Confetti Drop has zero tolerance for objectionable content and abusive users. You may not post, share, or use the Service to engage in:

• Harassment, bullying, threats, stalking, or intimidation
• Hate speech or content that attacks people based on protected characteristics
• Sexual content involving minors, exploitation, or any child sexual abuse material
• Pornography or graphic sexual content inappropriate for a celebration product
• Spam, scams, phishing, malware, or deceptive practices
• Illegal activity, or content that promotes illegal activity
• Impersonation, doxxing, or sharing others’ private information without consent
• Intellectual property infringement
• Attempts to bypass moderation, reporting, or technical protections

We may remove content, limit features, warn organizers, or disable accounts at our discretion when we believe these rules were violated. Organizers are responsible for who they invite and for moderating their own Drops in good faith, including using report and remove tools when available.

6. Reporting, blocking, and moderation

You can report contributions and block users in the app. Invite web pages may also offer a way to report a problem. Reports are reviewed by the Confetti Drop operator. We aim to act on confirmed serious violations within 24 hours while the product is actively operated. Urgent safety issues: email hello@confettidrop.app with subject “Safety”. More detail: Safety.

Blocking reduces how someone’s content appears to you where the product supports it; it does not guarantee complete invisibility in every shared context (for example a Drop you both still belong to).

7. Invites, surprises, and reveals

Invite links can allow anyone who has them to view or contribute. Treat links like invitations. In the current version, organizers open the reveal experience for recipients (including surprise Drops). Recipient self-serve claim flows may ship later and are not guaranteed by these Terms.

8. Funds and payments

Cash gift collection, wallets, and payouts are not part of the current App Store version. Do not send money expecting Confetti Drop to hold or transfer funds. If Apple Pay, Stripe Connect, or similar features launch later, additional payment terms, fees, and tax rules will apply and will be disclosed before you use those features.

9. Acceptable use of the platform

You agree not to:

• Scrape, overload, or interfere with the Service or its security
• Reverse engineer the app except where applicable law allows
• Use automated means to create accounts or spam Drops without permission
• Misrepresent your identity or affiliation in a deceptive way
• Use the Service for commercial spam or advertising without our written consent

10. Intellectual property

The Confetti Drop name, branding, app, website design, and software are owned by us or our licensors. These Terms do not give you rights to our trademarks or code except the limited right to use the Service as allowed here.

11. Third-party services

The Service relies on third parties (for example cloud hosting, authentication, email delivery, and Apple’s App Store). Their terms and availability may affect your experience. We are not responsible for third-party websites or services we do not control.

12. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that content from other users is accurate or appropriate. You use invite links and user-generated content at your own risk.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONFETTI DROP AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY) OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.

14. Indemnity

You agree to defend and indemnify Confetti Drop and its operators against claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms or law.

15. Termination

You may stop using the Service and delete your account at any time (Profile → Account). We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that should survive (including ownership, license grants for content already shared as needed to operate remaining Drops, disclaimers, and limitations) will survive termination.

16. Changes

We may update these Terms by posting a new version on this page and updating the “Last updated” date. Material changes may also be called out in the app. If you continue using the Service after changes take effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

17. Governing law

These Terms are governed by the laws of the United States, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence say otherwise. You and Confetti Drop agree that disputes will be handled in courts located in the United States, subject to those mandatory protections. If you form a company and choose a specific home state later, we may update this section to name that state.
